1. Acceptance and Eligibility

Welcome to PatioSet. These Terms of Service ("Terms") constitute a legally binding agreement between you and PatioSet ("we," "us," or "our") governing your access to and use of our website located at patioset.myshopify.com (the "Site") and your purchase of products through the Site.

By accessing, browsing, or placing an order on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree to these Terms, you must not use the Site or purchase products from us.

Eligibility. You must be at least 18 years of age, or the age of majority in your state of residence, to use this Site and place orders. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract. If you are using the Site on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including but not limited to situations involving prohibited conduct, suspected fraud, or violation of these Terms.

2. The Store and Products

PatioSet operates an e-commerce store offering outdoor furniture, patio sets, and related products. All product descriptions, images, specifications, dimensions, colors, and other details provided on the Site are intended to be as accurate as possible. However, we do not warrant that product descriptions, images, or other content on the Site are complete, current, accurate, or error-free.

Product Availability. All products are subject to availability. We make reasonable efforts to accurately display our inventory, but we cannot guarantee that products displayed as available will be in stock when you place your order. We reserve the right to discontinue any product at any time without notice.

Product Images and Colors. We strive to display product colors and images as accurately as possible. However, the actual color, texture, and appearance of products may vary from images displayed on the Site due to monitor settings, photography, lighting, and manufacturing variations. Such variations do not constitute a defect or grounds for return unless the product materially differs from its description.

Typographical Errors. In the event of a pricing, descriptive, or typographical error, we reserve the right to correct the error and/or cancel any orders placed based on incorrect information, even after an order confirmation has been sent. If your order is cancelled due to a pricing error, we will notify you and offer you the opportunity to purchase the product at the correct price or receive a full refund.

3. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the product(s) in your shopping cart subject to these Terms. All orders are subject to acceptance by PatioSet. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or violation of these Terms.

Order Confirmation. After you submit an order, you will receive an email acknowledging receipt of your order. This acknowledgment does not constitute our acceptance of your order; it is simply confirmation that we have received it. Our acceptance occurs when we send you an email confirming that your order has been shipped or is ready for delivery, at which point a binding contract is formed between you and PatioSet.

Order Accuracy. You are responsible for providing accurate and complete information when placing an order, including shipping address, billing address, email address, and payment information. We are not responsible for delays or non-delivery resulting from incorrect or incomplete information provided by you.

Order Modification and Cancellation. Once an order has been placed, we cannot guarantee that it can be modified or cancelled. If you need to modify or cancel an order, please contact us immediately at contact@patioset.shop or 3052067865. We will make reasonable efforts to accommodate your request if the order has not yet been processed or shipped, but we are under no obligation to do so. Once an order has shipped, our standard return policy applies (see Section 7 and our Returns & Refunds page).

Refusal of Orders. We reserve the right to refuse or cancel orders that appear to be placed by dealers, resellers, or distributors, or orders that we believe in good faith may involve fraudulent or suspicious activity. We may require additional verification or information before accepting an order.

4. Pricing and Sales Tax

Pricing. All prices displayed on the Site are in United States Dollars (USD) and are exclusive of applicable sales tax. Prices are subject to change at any time without notice. However, price changes will not affect orders that have already been accepted by us.

We make every effort to ensure that prices displayed on the Site are accurate. However, errors may occur. If we discover a pricing error after you have placed an order, we will notify you as soon as possible and give you the option to either confirm your order at the correct price or cancel your order for a full refund.

Sales Tax. Applicable state and local sales tax will be calculated and added to your order total at checkout based on the shipping destination address. The amount of sales tax charged will be displayed in your shopping cart and order confirmation. Sales tax rates vary by state and locality, and we collect and remit sales tax in accordance with applicable federal and state law. You are responsible for any use tax or other taxes or duties not collected by us at the time of purchase.

5. Payment

We accept payment by major credit cards, debit cards, and other payment methods as displayed on the Site at checkout. Payment is due in full at the time you place your order. By providing payment information, you represent and warrant that you are authorized to use the payment method provided and that the information you provide is accurate and complete.

Authorization and Charges. When you place an order, you authorize us (or our third-party payment processor) to charge the full amount of your order, including the purchase price, applicable sales tax, and any other fees or charges, to your designated payment method. We may authorize your payment method at the time you place your order or at the time of shipment.

Payment Processing. All payment transactions are processed through secure third-party payment processors. We do not store complete credit card information on our servers. Your payment information is subject to the privacy policies and terms of service of our payment processors in addition to our Privacy Policy.

Payment Disputes and Chargebacks. If you dispute a charge or initiate a chargeback with your credit card company or financial institution, we reserve the right to suspend or terminate your account and to dispute the chargeback if we believe the charge was valid. You agree to cooperate with us in resolving any payment disputes and to provide documentation or information we reasonably request.

Declined or Failed Payments. If your payment method is declined or a payment fails for any reason, we may cancel your order or suspend your access to the Site until payment is successfully processed. We are not responsible for any fees charged by your financial institution due to declined or insufficient funds.

6. Shipping and Delivery

We ship orders within the continental United States. Detailed information about our shipping methods, delivery times, and policies is available on our Shipping Policy page, which is incorporated into these Terms by reference.

Shipping Costs. Shipping within the United States is FREE. We do not charge shipping costs for orders delivered to addresses in the continental United States.

Delivery Time. Orders are generally delivered within 3-5 working days from the date of shipment. Delivery times are estimates only and are not guaranteed. Actual delivery times may vary depending on your location, carrier performance, and other factors beyond our control. We are not responsible for delays caused by the shipping carrier, weather, customs, or other events outside our reasonable control.

Shipping Address. You are responsible for providing a complete and accurate shipping address. We are not responsible for orders delivered to an incorrect address provided by you. If a package is returned to us due to an incorrect address, insufficient address information, or refusal of delivery, you may be responsible for additional shipping charges to reship the order.

Risk of Loss. All products purchased from PatioSet are shipped pursuant to a shipment contract. This means that the risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for filing any claims with the carrier for damaged or lost shipments.

Tracking Information. Once your order has shipped, we will send you an email with tracking information so you can monitor the progress of your delivery. You are responsible for monitoring your shipment and being available to receive delivery.

7. Returns and Refunds

We want you to be satisfied with your purchase. If you are not completely satisfied, you may return eligible products in accordance with our return policy. Detailed information about our returns process, eligibility requirements, and refund procedures is available on our Returns & Refunds page, which is incorporated into these Terms by reference.

Return Window. You may return eligible products within 30 days from the date of delivery. Returns must be initiated within this 30-day period to be eligible for a refund or exchange. Please note that this return period is our voluntary return policy; most online purchases in the United States are not covered by a statutory right of withdrawal or cooling-off period.

Return Eligibility and Condition. To be eligible for return, products must be unused, in their original condition, and in their original packaging with all tags, labels, and accessories included. Certain products may not be eligible for return due to hygiene, safety, or customization reasons. Please refer to our Returns & Refunds page for specific details on return eligibility.

Initiating a Return. To initiate a return, please contact us at contact@patioset.shop or 3052067865 with your order number and details about the product you wish to return. We will provide you with instructions for completing your return, including the return address and any required documentation.

Refunds. Once we receive and inspect your returned product, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed and a credit will be applied to your original payment method within a reasonable period of time. Refunds do not include any original shipping costs unless the return is due to our error or a defective product.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, photographs, videos, software, and other materials (collectively, "Content"), as well as the selection, arrangement, and design of the Content, are owned by or licensed to PatioSet and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks. "PatioSet" and all related logos, product names, service marks, and trade names displayed on the Site are trademarks or registered trademarks of PatioSet or its licensors. You may not use any of these trademarks without our prior written permission. All other trademarks, service marks, and trade names that appear on the Site are the property of their respective owners.

Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use and for the purpose of browsing and purchasing products. This license does not include any right to: (a) resell or make commercial use of the Site or its Content; (b) collect or use product listings, descriptions, or prices for the benefit of another merchant; (c) make derivative uses of the Site or its Content; (d) download or copy account information; or (e) use data mining, robots, or similar data-gathering or extraction tools.

Restrictions. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from the Site, except as expressly permitted by these Terms or with our prior written consent. You may not frame or utilize framing techniques to enclose any trademark, logo, or other Content without our express written consent. You may not use any meta tags or other hidden text using our name or trademarks without our express written consent.

Digital Millennium Copyright Act. If you believe that any Content on the Site infringes your copyright, please notify us in writing at contact@patioset.shop with the information required by the Digital Millennium Copyright Act (DMCA), including: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and information sufficient to permit us to locate it; (c) your contact information; (d) a statement that you have a good faith belief that use of the material is not authorized; (e) a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

9. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation;
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation;
  • To impersonate or attempt to impersonate PatioSet, a PatioSet employee, another user, or any other person or entity;
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm PatioSet or users of the Site or expose them to liability;
  • To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site;
  • To attack the Site via a denial-of-service attack or a distributed denial-of-service attack;
  • To use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site, without our prior written consent;
  • To use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent;
  • To engage in any other conduct that violates these Terms or that we determine, in our sole discretion, to be harmful to PatioSet, our customers, or other third parties.

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, if you breach any of these acceptable use provisions or any other provision of these Terms.

10. Disclaimers of Warranties

YOUR USE OF THE SITE AND YOUR PURCHASE AND USE OF PRODUCTS ARE AT YOUR SOLE RISK. THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PATIOSET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE OR ANY PRODUCTS IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. WE DO NOT
